Terms of Service
These terms explain the rules that apply to CueVity software, accounts, licensing, purchases, and related KGM Studios services.
1. Agreement
These Terms of Service govern your use of CueVity software, the CueVity website, CueVity Account, licensing services, and related services provided by KGM Studios. By installing, accessing, purchasing, activating, or using CueVity, you agree to these Terms.
2. Software License
Subject to these Terms and the license edition you obtain, KGM Studios grants you a limited, non-exclusive, non-transferable right to install and use CueVity for lawful purposes.
CueVity is licensed, not sold. Ownership of the CueVity software, source code, branding, and related intellectual property remains with KGM Studios and its applicable licensors.
3. CueVity Editions
Free
The Free edition may be used without a paid license key, subject to the features and limitations made available in that edition.
Rent
A Rent license is time-limited, is purchased for the selected number of days, and supports activation on up to two devices. Rental expiration is determined by CueVity licensing services.
Professional — 2 Devices
A permanent Professional license permits activation on up to two devices, subject to the applicable license and version eligibility.
Professional — 4 Devices
A permanent Professional license permits activation on up to four devices, subject to the applicable license and version eligibility.
4. Permanent Professional Licenses
After successful activation, a permanent Professional license is intended to continue normal licensed runtime operation without continuous account sign-in or an ongoing internet connection.
The permitted device count remains part of the license. Activating additional machines beyond the allowed device count may require deactivating an existing device or otherwise resolving the activation through supported license-management procedures.
5. CueVity Account
Paid purchases may be associated with a CueVity customer account using a verified email address. CueVity may support Email and Password authentication and Google Sign-In as account access methods.
You are responsible for maintaining control of your account credentials and for providing accurate information. You must not attempt to access another customer's account, purchases, or licenses without authorization.
6. Versions and Upgrade Eligibility
A CueVity license may include a supported major version. A purchase for one major version does not automatically guarantee entitlement to every future major version unless KGM Studios expressly states otherwise.
Purchase history and customer ownership may be used to determine eligibility for future upgrades, discounts, or offers.
7. Restrictions
You may not, except where applicable law expressly permits otherwise:
- Share, sell, rent, sublicense, or distribute a license key or account access in violation of its permitted use.
- Bypass or defeat license activation, device limits, rental expiry, or other technical protection measures.
- Use CueVity or its services to gain unauthorized access to systems, accounts, purchases, or licenses.
- Remove or misrepresent CueVity or KGM Studios copyright, trademark, or ownership notices.
8. Purchases, Payments, and Refunds
Prices, billing periods, taxes, accepted payment methods, and any refund terms applicable to a purchase will be presented through the relevant purchase process or policy when commercial sales are made available.
Rent access ends when the purchased rental period expires. Failed, cancelled, abandoned, refunded, or reversed payments may prevent or revoke the related paid entitlement, subject to applicable consumer rights.
9. Updates and Service Changes
KGM Studios may provide fixes, updates, new versions, feature changes, or service changes. Some online account or licensing functionality may evolve over time. Permanent Professional runtime rights for a valid activated license are governed by the applicable license terms and supported version.
10. Production Responsibility
CueVity is a technical show-control tool. You are responsible for testing your projects, media, routing, connected equipment, backup procedures, and show configuration before live use. You should maintain appropriate operational backups and contingency procedures for critical productions.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, CueVity and related services are provided on an “as available” basis without warranties that cannot legally be excluded. KGM Studios does not guarantee that software or online services will be uninterrupted or error-free in every hardware, network, media, or production environment.
12. Limitation of Liability
To the maximum extent permitted by applicable law, KGM Studios will not be liable for indirect, incidental, special, consequential, or similar losses arising from use of CueVity, including loss of production time, data, revenue, or business opportunity. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
13. Suspension and Termination
KGM Studios may suspend access to online account or licensing services where reasonably necessary to address fraud, unauthorized access, abuse, security threats, or material violation of these Terms. Any action will remain subject to applicable law and the rights associated with a valid license.
14. Changes to These Terms
These Terms may be updated as CueVity, commercial offerings, or legal requirements change. The effective date at the top of this page identifies the current published version.
